TERMS OF USE - STEREOTICKET OFFER, SALE AND PURCHASE OF TICKETS

These Terms and Conditions of Pozitivan ritam d.o.o., Company ID No.: OIB: 66044886147, MBS: 130045464, with a registered seat on Marulićeva 49, Pula, Croatia, incorporated in Trgovački sud u Pazinu (hereinafter referred to as “Pozitivan ritam”), govern the rights and obligations between Pozitivan ritam and third parties consequent upon sales of Admission Tickets for sports-, cultural- and other events through the StereoTicket sales network, operated by Pozitivan ritam and any and all relationships associated therewith.

  1. The User of the Service may, through the Service, purchase tickets to the performances that have been offered (embedded) for sale through the Service (Applications, Service Pages).
  2. Purchasing tickets via the Service may be made by a user of the Service after loggin in to their User Profile (but not required).
  3. In order to purchase the ticket (s) via the Service, the User of the Service is obliged to:
    1. log in to their User Profile, or enter a valid email address where the ticket will be sent;
    2. select a performance and buy tickets through the StereoTicket ticketing system (by default, the button “BUY TICKETS” is displayed);
    3. become properly acquainted with the data and conditions of the performance and the data and conditions of the user of the Service who offered (inserted) the performance to the Service;
    4. click the “BUY TICKETS” button to open the electronic ticket purchase form (“Purchase Form”);
    5. fill in the Purchasing Form with all required data (eg sector selection, number of tickets purchased);
    6. choose a payment method – credit or debit card payment or PayPal
    7. familiarize themselves properly with the purchase price of purchased tickets (including any additional transaction fees that are always visible at the ticket price);
    8. become familiar with these Terms;
    9. click on the “BUY” button to confirm the data and facts filled in the Purchase Form; and
    10. after clicking on the “BUY” button, the user of the Service is automatically redirected either to the website of payment gateway provider, where he / she completes the purchase of the tickets.

    Ticket purchase is successfully accomplished by successfully paying the purchase price of the tickets, i. successful execution of a payment transaction through a payment mechanism – CardPay or PayPal and crediting the purchase price of the tickets to the Operator account involved in the payment mechanism – CardPay or PayPal. In case of any complications with the successful purchase of tickets, the Operator must be contacted at support.hr@stereoticket.com.

  4. The User of the Service shall be promptly informed about the successful purchase of the tickets and the Operator shall immediately send and / or make available purchased tickets to the User of the Service.
  5. After successful purchase of the ticket, the purchased ticket shall be immediately provided to the user of the Service in the following way:
    1. “E-ticket” – hometicket ticket is a method of distributing tickets solely by means of an e-mail address to which the user of the Service will be sent an electronic ticket immediately after the successful purchase of the ticket. The ticket must then be printed on a white A4 sheet of paper. To accept a ticket, each printed ticket must contain:
      • clear and readable QR code;
      • the title of the performance, the date of the performance, the start time of the performance, the venue of the performance, the purchase price of the ticket and the indication of the venue purchased;
      • sales number; and
      • the name and tax information of the show organizer.
    2. “Mobile Ticket” – the mobile ticket is available immediately after the successful purchase of the ticket, in the User profile of the Service user, namely in the section “PURCHASED TICKETS”.

    The mobile ticket contains a clearly readable and complete QR code, the title of the performance, the date of the performance, the start time of the performance, the venue of the performance, the purchase price of the ticket, the place of purchase.

    A mobile ticket can be shown when entering the show. An internet connection is required to open a mobile ticket, so we recommend that you check the internet connection at the venue, load the mobile ticket in advance, or use a hometicket ticket before entering the show.

  6. Each performance ticket can be used only once, regardless of how many forms it is provided to the Service user as a buyer (or made available, eg as a hometicket ticket and a mobile ticket). Any unauthorized handling of the tickets gives rise to liability and infringement rights. Such action may entail an obligation to make good the damage and criminal penalties.
  7. If after the purchase of the ticket (s) the performance data is changed, which shall consist of:
    • changing the venue of the performance; or
    • by changing the date of the performance of the performance; or
    • changing the content of the performance (i.e., changing the performer if one performer – eg a music band – is to perform), or at least 1/3 of the performers if more performers – eg a music band is to be performed); or
    • canceling the performance;

    a user of the Service who has made a purchase of the ticket (s) to perform through the StereoTicket ticketing system prior to making such a change to the performance data (any changes under a) to d) above) is entitled (but not required) to withdraw from the contract with a user of the Service who has offered (entered) the Service to the Service and filled out (chose) as the channel of the ticket sales for that show StereoTicket ticketing system, which originated by purchasing the ticket (s) for the show through the StereoTicket ticketing system and or tickets) for the performance, which he paid through the StereoTicket ticketing system.

    For performances, StereoTicket, s.r.o. is only the ticket provider. In case of cancellation or if the performance does not take place, StereoTicket, s.r.o. is not liable for entrance fee refunds. In the event of a refund, only the ticket price will be reimbursed. Unless the terms and conditions of the respective operator or venue follow a different policy, tickets can be returned for refund up until two months after the scheduled event date.
    The following applies if the operator commissions StereoTicket, s.r.o. to refund the entrance fees, mobile Ticket and E-ticket users will receive the respective amount – if it has already been paid – without further request in the same way they purchased their Mobile ticket or E-ticket. The Mobile ticket or E-ticket is automatically devaluated in the course of this process.

    In the case of cancellation, postponement or any other change of an event, StereoTicket, s.r.o. reserves the right to inform customers who purchased tickets for this event. Providing this information is a voluntary service of StereoTicket, s.r.o. and may be received by e-mail.

    Cast and program are subject to change, as long as the changes are reasonable, minor and objectively justified. This also applies to changes in stage construction (plans), as long as they were initiated or required by the promoter or artists. In case of a cancellation, postponement or change, additional expenses (e.g. travel to the venue, hotel) will not be refunded.

  8. The User of the Service who has offered (entered) the Performance to the Service and completed (selected) as the channel of the sale of the performance to the Performance StereoTicket ticketing system is obliged to change any performance data notify the Operator of these Terms and Conditions prior to its execution, but no later than 1 hour after its implementation, by e-mail to support.hr@stereoticket.com.

    The Operator shall then notify all users of the Service who have purchased the ticket (s) for the performance affected by the StereoTicket ticketing system by e-mail sent to the e-mail address provided by the users of the Service, made available to the Service, no later than 24 hours after receipt of the notice of change from the user of the Service under the previous sentence.

  9. The User of the Service who has purchased the ticket (s) for performance through the StereoTicket ticketing system prior to making a change to the performance data under point 7 (a) to (d) of these Terms and Conditions may withdraw from the contract and refund the full purchase price. apply tickets (or tickets) pursuant to clause 7 of these Terms and Conditions within 48 hours of sending notice of such change to the Operator pursuant to clause 8 of these Terms and Conditions by email containing the exercise of this authorization delivered to the email address support.hr@stereoticket.com within 48 hours of sending notice of such change to the Operator pursuant to clause 8 hereof. Upon expiry of this period, the right to withdraw from the contract and return the full purchase price of the ticket (s) pursuant to point 7 and se. of these Terms and Conditions shall cease in full and without any compensation. E-mail of the user of the Service containing the exercise of the right of withdrawal and return of the full purchase price of the ticket (s) pursuant to point 7 and seq. of these Terms must include, inter alia:
    • identification of the User Account and the User Profile of the Service user exercising the authorization; or the email address to which he purchased the ticket
    • his contact e-mail to address this matter; and
    • the identification number of the ticket (or all tickets) to which it (s) exercises the right of withdrawal.
  10. The User of the Service who has exercised the right of withdrawal and to whom the purchase price of the ticket (s) pursuant to point 7 and seq. of these Terms and Conditions is not entitled to use the ticket (or none of the tickets) against which the right of withdrawal has been exercised and the purchase price refunded in any way without limitation (in particular, but not limited to, participation in the performance, sale, donation or any other transfer of the ticket (s) to any third party, etc.). Any unauthorized handling of the tickets gives rise to liability and infringement rights, in particular the Civil Code, the Criminal Code, the Copyright Act and the rights related to copyright and other applicable regulations. Such action may entail, inter alia, an obligation to make good the damage and criminal penalties.
  11. The User of the Service, as the Buyer, acknowledges and unreservedly accepts that the withdrawal from the contract resulting from the purchase of the ticket (s) for performance through the StereoTicket ticketing system, for any reason other than as expressly stated in clause is not possible. Performances are services related to leisure activities, which the seller undertakes to provide within the agreed time or within the agreed time on the basis of a distance contract or a contract concluded off the premises of the seller and amending and supplementing certain laws.

Confidentiality of your information is protected and secured by using SSL encryption. Pages for web payment are secured by using Secure Socket Layer (SSL) protocol with 128-bit data encryption. SSL encryption is a data coding procedure for prevention of unauthorized access during data transfer. This enables a secure data transfer and prevents unauthorized data access during communication between user and Monri WebPay Payment Gateway and vice versa. Monri WebPay Payment Gateway and financial institutions exchange data by using their virtual private network (VPN) which is also protected from unauthorized access. Monri Payments is PCI DSS Level 1 certified payment service provider. Credit card numbers are not stored by Merchant and are not available to unauthorized personnel.
